On Friday, Apple appealed the decision of a federal judge in a legal battle with Fortnight maker Epic Games over the control of the Apple Store. U.S. District Court Judge Yvonne Gonzalez-Rogers has asked the San Francisco Ninth Circuit Court of Appeals to overturn a 185-page ruling.
The judge ordered Apple Pal to give up control of its App Store payment options, but Epic failed to prove any breach of trust. Epic filed its own appeal last month. “We will fight,” Epic CEO Tim Sweeney tweeted when the company confirmed its plan to fight this decision.
A few days after Gonzalez-Rogers made the decision, Apple said it was “very satisfied” with the decision, but still opened the door to appeals. The two companies chose the so-called trial, and the judge said that the jury would hear the evidence and decide the verdict. Epic initiated this case to break the fraud control of the App Store, accusing the iPhone manufacturer of acting as if it monopolized digital goods or services in its store.
“For me, this is a victory for Apple, because the judge has made it clear that they are not involved in monopolistic behavior,” said Carolina Milanesi, a creative strategy analyst. “I don’t think this is a problem for Apple as far as revenue is concerned.” The judge prohibited Apple Pal developers from including “external links or other call-to-actions to direct customers to the purchase mechanism” in their apps. Apple Paul can still order its payment system for in-app transactions.
