The new ‘no-fault divorce’ in England promises to put an end to the ‘blame game’

Divorce, Dissolution and Separation Act (2020) came into effect on Wednesday. It is one of the biggest revamp of divorce laws in England and Wales. The act does away with any “blame game” and instead helps separating spouses to focus on “key practical decisions involving children or their finances”.

The new law will allow couples to get divorced in a considerably shorter amount of time by stating that their marriage broke down “irretrievably”. Known as the ‘no-fault divorce’, the reforms in England and Wales bring the countries in line with Scotland, which has its own legal system.

A ‘no-fault divorce’ has come into effect in the UK. This means that a spouse, or couple jointly, can apply for divorce. The new law removes “unnecessary finger-pointing and acrimony” between couples. It also ensures that one spouse cannot “vindictively” contest a divorce.
