AMPSolar had petitioned the Commission to direct Uttar Pradesh distribution companies (DISCOMs) to approve the commercial operation date for a portion of an open-access project being developed in the state. The petitioner also asked the Commission to hold and declare the Commission’s previous order, dated 24th February 2021, to be made universally applicable to all solar projects in the state. The Tilhar project had already been commissioned, according to the Commission, and the solar generator’s requests for the project were invalid.
The Begumpur project, on the other hand, was still waiting to be granted long-term open access (LTOA), so the petitioner’s request for relief was premature. Until the Commission issues specific regulations governing the commissioning of solar projects and the declaration of commissioning dates, the Commission’s previous order will remain in effect. The Commission also stated that the petitioner’s affiliate companies may approach the Commission with relevant details and justifications and that the matter would be decided under the applicable orders and regulations on the petition’s filing date. The Uttar Pradesh Electricity Regulatory Commission Regulations, 2019, are open access regulations announced by Uttar Pradesh. Long-term open access customers will have priority over medium-term open access customers and short-term open access customers, according to the regulations.
