Yogi Adityanath invokes ESMA, bans strikes in UP for 6 months

The Yogi Adityanath government has banned strikes in the states for six months. According to the Hindustan Times’ sister publication Livehindustan, on Sunday, the new chief secretary, Dr. Devesh Kumar Chaturvedi, issued a notice.

According to a further report by Livehindustan, it pointed out that any public services, companies and local authorities dealing with state affairs in Uttar Pradesh prohibit strikes.

The notice warned that those who disobey the order will face legal proceedings.

In early May, the Uttar Pradesh government banned strikes for six months by invoking the Basic Services Maintenance Act or ESMA. This decision was made because of the coronavirus disease (Covid-19) pandemic.

The ESMA Act authorizes the state government to take action against employees who strike or refuse to perform basic services important to maintaining normal lives. If anyone is found to be violating its regulations, it gives the state police the power to arrest anyone without any warrant. The bill provides for mandatory imprisonment, which may be as long as one year, or a fine of 1,000 rupees, or both.

The Uttar Pradesh government invoked ESMA in May last year and extended the ban on strikes for another six months in November 2020.

Uttar Pradesh recorded 23 new Covid-19 cases on Sunday, which increased the number of active Covid-19 cases receiving treatment to 196.

Association Secretary-General Dr. Abhishek Shukla said: “The positive test rate (TPR) in the past 24 hours was 0.012%. A total of 1,88,560 samples were tested (within 24 hours) and 23 of them were found to be positive for Covid.” International Doctor.

According to the state health department, there were 189 active Covid cases on Saturday and 164 on Friday. A total of 16 patients recovered in the past 24 hours. As of now, 16,87,584 patients in the state have recovered.

So far, Uttar Pradesh has tested 9,07,50,349 Covid samples.
