Narcotics act amendment bill in Rajya Sabha for passage

After being passed by the People’s Court on Monday, the Narcotics and Psychotropic Substances (Amendment) Bill of 2021 will be reviewed and passed in Rajya Sabha on Wednesday. It aims to replace the 2021 Narcotics and Psychotropic Substances (Amendment) Regulations.

Treasury Secretary Nirmala Sitalaman may introduce the bill in the second half of the proceedings of the House of Lords.

According to the PRS legislative study, this bill amended the Narcotics and Psychotropic Substances Act of 1985 to correct drafting errors. The bill regulates certain operations (such as manufacturing, transportation, and consumption) related to narcotic drugs and psychotropic substances.

The law was amended in 2014, and the number of the definition clauses for this type of illegal activity was revised. However, the penalties for funding these illegal activities have not been revised, and the earlier article numbers continue to be cited, making the penalties impossible to implement. The bill amended the penalty section to change the reference to the new clause number. Finance Minister Nirmala Sitalaman told Parliament that the retrospective clause in the bill is not “substantial” in nature.

The bill was originally scheduled to be reviewed on Tuesday.
