Now, any Indian citizen can buy land in Jammu & Kashmir
In a huge move, the Center has prepared for individuals from outside Jammu and Kashmir to purchase land in the Union domain (UT) by altering a few laws.
The MHA advised what it calls UT of Jammu and Kashmir Reorganization (Adaptation of Central Laws) Third Order, 2020. The Center has revoked or subbed 26 state laws.
In a newspaper warning, the Center has excluded the expression “lasting occupant of the state” from Section 17 of the Jammu and Kashmir Development Act that manages removal of the land in the association domain.
Before annulment of Article 370 and Article 35-An in August a year ago, non-inhabitants couldn’t accepting any steadfast property in Jammu and Kashmir. In any case, the new changes have made ready for non-inhabitants to purchase land in the association region.
Lieutenant Governor Manoj Sinha told columnists that the alterations didn’t permit move of horticultural land to non-agriculturists.
Be that as it may, there are a few exceptions in the Act which empower move of agrarian land for non-horticultural purposes, including setting up of instructive or medical services offices.
Previous Advocate General Mohammad Ishaq Qadri said the changes have opened conduits for individuals from outside Jammu and Kashmir to purchase lands. “Presently there is no legitimate bar on acquisition of land here by untouchables,” he said.
The MHA warning will come into power with quick impact.
Responding to the MHA warning, National Conference pioneer Omar Abdullah said that J&K is presently available to be purchased.
“Unsatisfactory changes to the land proprietorship laws of J&K. Indeed, even the posturing of home has been discarded when buying non-rural land and move of rural land has been made simpler. J&K is currently available to be purchased and the more unfortunate little land holding proprietors will endure,” Omar Abdullah said in a tweet.
